TERMS AND CONDITIONS
These Terms and Conditions govern the reservation, purchase, sale, delivery, and transfer of any puppy offered by Royal Puppy Love. By using this website, submitting an inquiry, paying a holding fee, signing a contract, electronically accepting terms at checkout, or accepting delivery of a puppy, Buyer acknowledges that Buyer has read, understood, and agreed to be bound by these Terms and Conditions, together with any applicable invoice, puppy listing, checkout disclosures, package terms, and other written policies expressly incorporated into the transaction.
- Puppy Availability and Listings
All puppies are offered subject to prior sale and ongoing availability. A puppy is not considered reserved until Royal Puppy Love has accepted the holding fee and sent Buyer written confirmation by email that the puppy is sold to Buyer and the reservation is complete. Royal Puppy Love reserves the right to correct errors in pricing, availability, descriptions, package inclusions, pedigree information, photographs, or other website content at any time prior to delivery.
Photographs, estimated adult size, coat, color, temperament, and descriptive language are provided for general informational purposes only and are not guarantees unless expressly stated in a separate written agreement signed by Royal Puppy Love.
- Puppy Reservation Service (Holding Fee)
Buyer shall pay Royal Puppy Love a holding fee in exchange for Royal Puppy Love reserving the selected puppy exclusively for Buyer. Buyer acknowledges and agrees that the reservation service is completed when Royal Puppy Love sends Buyer written confirmation by email that the puppy is sold to Buyer and the reservation is complete. Upon transmission of that confirmation email, the holding fee is earned.
The holding fee is non-refundable except if Royal Puppy Love is unable to deliver the puppy, if the puppy is found prior to delivery to have a serious health condition that makes placement inappropriate, or if Royal Puppy Love declines or cancels the sale prior to delivery.
If Buyer timely completes the purchase of the selected puppy, the holding fee shall be applied as a credit toward the total purchase price of that puppy.
The holding fee may be transferred to a future litter for up to six (6) months from the original payment date, subject to availability. Future litters are not guaranteed, and any transferred holding fee not used within the six (6) month period shall expire.
- Package Terms
Royal Puppy Love may offer puppies under different package options, including but not limited to the Premium Package, Standard Package, and Cash N Dash Package. The package selected by Buyer determines what benefits, services, and protections are included in the transaction.
Buyer understands and agrees that the Premium Package is the only package that includes a Health Guarantee.
- Health Guarantee / As-Is Sales
A separate written Health Guarantee, together with the puppy’s complete health record through the date of delivery and a copy of the veterinarian examination, shall be provided to Buyer only at the time of delivery and only if Buyer has purchased the Premium Package.
Buyer understands and agrees that puppies sold under the Standard Package or the Cash N Dash Package are sold AS IS, WHERE IS, WITH ALL FAULTS, whether known or unknown, including known or unknown health conditions, except as otherwise expressly required by applicable law.
If Buyer purchases the Premium Package, the separate written Health Guarantee delivered at the time of delivery shall control all health-related terms, exclusions, limitations, claim procedures, and Buyer obligations. No health guarantee exists unless it is contained in that separate written Health Guarantee delivered with the puppy.
For puppies sold under the Standard Package or the Cash N Dash Package, Royal Puppy Love’s responsibility is limited to providing the available health records, vaccination and deworming history, and veterinarian documentation in Seller’s possession at the time of delivery.
No oral statement, website description, advertisement, photograph, text message, social media post, or informal communication shall create any Health Guarantee or warranty not expressly stated in the separate written Health Guarantee delivered only with the Premium Package.
- Purchase Price and Final Payment
The total purchase price and itemized charges for the puppy shall be shown on the applicable invoice, checkout page, or purchase agreement.
After crediting any holding fee as provided above, the remaining balance of the purchase price shall be due when the puppy reaches seven (7) weeks of age if the puppy will be flying or delivered by courier. If the puppy is being picked up in person, the remaining balance shall be due in cash only at the time Buyer takes possession of the puppy. No Cash App, credit cards, or checks will be accepted at in-person pickup unless expressly approved in writing by Royal Puppy Love.
If Buyer intends to pay any portion of the remaining balance by credit card, Buyer must make arrangements with Royal Puppy Love when the puppy reaches seven (7) weeks of age, and any approved credit card payment shall be due at that time and shall include a four percent (4%) convenience fee.
Applicable Oklahoma sales tax shall be added to the purchase price where required.
- Shipping, Delivery, and Pickup
All shipping and/or transportation expenses for the puppy, to and from Royal Puppy Love’s residence and to and from Buyer’s residence, are Buyer’s responsibility unless otherwise expressly stated in writing.
Airline shipping expenses may include airfare, airline-required health certificate, crate, shipping kit, and related materials, all of which must be paid by Buyer prior to shipping.
Courier fees include only the courier’s transportation charge and do not include the cost of a pet taxi, carrier, crate, supplies, or other travel-related items unless expressly stated otherwise.
- Boarding and Failure to Pick Up
If Buyer asks Royal Puppy Love to hold the puppy beyond nine (9) weeks of age, Buyer must pay the remaining balance in full before the puppy will be held. In addition, a boarding fee of $8.00 per day applies and must be paid in advance.
The puppy will be held only until twelve (12) weeks of age unless otherwise agreed in writing. After that time, Royal Puppy Love may place the puppy back up for sale without further notice to Buyer, and Buyer shall forfeit all amounts paid with no refund.
No refund will be offered if Buyer fails to pick up or accept delivery of the puppy by the agreed time.
- Documentation Provided
At the time of delivery, Royal Puppy Love will provide the health records available for the puppy, including vaccinations, dewormers, medications administered, and the date of the next scheduled vaccination, together with a copy of the veterinarian examination then in Seller’s possession.
If Buyer has purchased the Premium Package, Royal Puppy Love will also provide the separate written Health Guarantee at the time of delivery. If Buyer purchases a puppy under the Standard Package or Cash N Dash Package, no Health Guarantee will be provided, and the puppy is sold AS IS, WHERE IS, WITH ALL FAULTS.
Microchip registration, AKC registration, and other items may depend on the package purchased and shall be governed by the package description and invoice.
- Right to Refuse or Cancel Sale
Royal Puppy Love reserves the right to refuse, decline, or cancel any sale prior to delivery, with or without cause, in its sole discretion. In the event Royal Puppy Love refuses or cancels the sale prior to delivery, Buyer shall be refunded all amounts paid to Royal Puppy Love.
- No Oral Modifications
No oral statement, prior discussion, text message, email, advertisement, photograph, social media post, or prior course of dealing shall alter or amend these Terms and Conditions unless expressly confirmed in a written agreement signed by Royal Puppy Love.
- Limitation of Liability
Except as expressly stated in a written Health Guarantee or other written agreement signed by Royal Puppy Love, Royal Puppy Love shall not be liable for incidental, indirect, consequential, special, or exemplary damages, including but not limited to veterinary expenses, travel costs, boarding costs, emotional distress, lost wages, or other related expenses arising out of or related to the reservation, purchase, sale, delivery, condition, behavior, or ownership of the puppy.
- Governing Law and Venue
These Terms and Conditions and any dispute arising out of or relating to the reservation, purchase, sale, delivery, or ownership of the puppy shall be governed by the laws of the State of Oklahoma. Exclusive venue for any such dispute shall lie in the District Court of Pottawatomie County, Oklahoma.
- Electronic Acceptance
By checking any required box, typing a name, electronically signing, submitting payment, or accepting delivery of the puppy, Buyer agrees to conduct the transaction electronically and acknowledges that such action constitutes Buyer’s legally binding electronic signature and acceptance of these Terms and Conditions and all incorporated policies.
