Companion Puppy Health Guarantee and Agreement
Initial Money-Back Health Guarantee
YOUR PUPPY IS GUARANTEED TO BE IN GOOD HEALTH. To validate this Health Guarantee, Buyer must have the puppy examined by a licensed veterinarian within seven calendar days of the date of this contract. Proof of the veterinary examination must be provided to Seller by mail, email, or text within ten calendar days after the examination.
If this is not done, this Health Guarantee becomes invalid, and Buyer assumes all responsibility for the health of the puppy. The puppy will be considered purchased “as is.”
If the examining veterinarian finds that the puppy has a life-threatening congenital defect, the puppy will be exchanged for another puppy or Buyer’s money refunded, at Buyer’s choice, provided Seller receives a written letter from the examining veterinarian as evidence of the puppy’s condition and Seller is notified within 24 hours of the examination. The puppy must be returned within two days of the examination. NO EXCHANGES OR REFUNDS WILL BE MADE AFTER THIS PERIOD.
Seller is not responsible for veterinary charges incurred by Buyer or for Buyer’s change of mind.
Buyer must complete the puppy’s vaccination schedule on time and follow the medical advice of a veterinarian. Failure to do so voids this Health Guarantee. Buyer should consult a veterinarian regarding heartworm prevention and provide yearly veterinary examinations, including heartworm detection, fecal examinations, and vaccinations required by the veterinarian. This Health Guarantee is void if Buyer knew, or should have known, that the puppy was sick and failed to seek immediate veterinary care.
One-Year Congenital Health Guarantee
Seller guarantees the puppy for one year from its date of birth against congenital disorders of a severe, life-threatening nature, including severe defects of the heart, hips, kidneys, pancreas, spine, or liver.
If the puppy dies within that one-year period, Buyer must pay for an autopsy performed by a teaching institution to determine the cause of death. If the autopsy establishes beyond doubt that the puppy died from a genetic defect, Seller will replace the puppy or refund Buyer’s money at Seller’s discretion. No money will be refunded under this One-Year Congenital Health Guarantee without an autopsy.
For a living puppy, the genetic condition must be sufficiently serious, in the opinion of two qualified veterinarians, at least one of whom is selected by Seller, to warrant euthanasia. Seller is not responsible for veterinary fees or other expenses except as expressly stated in this contract.
Exclusions
This Health Guarantee does not cover:
- Regular veterinary care, food, medicine, supplements, training, grooming, cleaning, or other expenses associated with raising and owning the puppy.
- Injuries or accidents, including ingestion of foreign matter, choking, falls, scrapes, bumps, bruises, insect bites, human-inflicted injuries, running away, vehicle-related injuries, or illness or injury resulting from or related to veterinary procedures.
- Behavior, personality, or temperament traits, including potty-training difficulties, chewing, and digging.
- Appearance, size, physical characteristics, breed standards, aesthetic preferences, show quality, coat quality, adaptability, breeding ability, or fitness for a particular purpose.
- Uneven bites, undescended testicles, inguinal or umbilical hernias, allergies, cataracts, grade 1 or 2 luxating patellas, grade 1 or 2 heart murmurs, hypoglycemia, or other non-life-threatening or treatable disorders.
- Results of genetic testing of any kind, including breed, coat-color, size, eye-color, ancestry, or purebred testing.
- Contagious illnesses first diagnosed more than seven calendar days after the puppy’s arrival.
- Parasites first diagnosed more than five calendar days after the puppy’s arrival, including Giardia, coccidia, fleas, ticks, ear mites, and mange.
- Hereditary diseases diagnosed more than one year after the puppy’s date of birth.
- Any animal other than the puppy identified in this contract and on the related invoice.
Any known health condition disclosed on the puppy’s invoice and in the puppy’s separate Veterinary Examination Report before delivery is accepted by Buyer and excluded from this Health Guarantee.
Companion Puppy – No Breeding
The puppy is sold solely as a companion without breeding rights. Buyer must have the puppy spayed or neutered by 12 months of age and provide veterinary proof to Royal Puppy Love. Buyer shall not breed or permit the breeding of the puppy.
If the puppy is bred without Royal Puppy Love’s prior written authorization, this Health Guarantee becomes null and void. Unauthorized breeding entitles Royal Puppy Love to court proceedings and minimum reimbursement of $18,000 for each unauthorized breeding.
Any breeding or show-rights placement requires Royal Puppy Love’s prior approval and a separate written agreement signed by Royal Puppy Love.
Care
Beginning when Buyer takes possession of the puppy, all care is at Buyer’s expense. During the life of Buyer’s ownership of the dog, Buyer will take all measures to maintain the health and well-being of the dog for as long as Buyer retains ownership. Buyer will provide a good home with no physical abuse, warm and dry bedding with good protection from the weather and the elements, regular exercise, affection, proper nutrition, and health care for the dog, including inoculations and heartworm prevention as discussed between Buyer and a licensed veterinarian. By accepting this agreement, Buyer certifies that the dog will live with Buyer as a house dog and will never be tied or staked to a rope, chain, or cable.
Governing Law and Agreement
This Companion Puppy Health Guarantee and Agreement is incorporated into and made part of the applicable BCP Sales Invoice. By signing the sale documents or accepting delivery of the puppy, Buyer agrees to these terms. These terms may be changed only through a written agreement signed by Royal Puppy Love.
This contract is governed by Oklahoma law. Any dispute shall be determined in Pottawatomie County, Oklahoma. No other state’s laws shall apply, regardless of where Buyer resides.
